1. Agreement to Terms
By accessing or using 360Onboard ("Service"), operated by DDS Media Marketing LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Service.
2. Use of Service
2.1 Eligibility
You must be at least 18 years old to use this Service. By using the Service, you represent that you meet this requirement.
2.2 Account Registration
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account
You must provide accurate and complete information during registration
You must notify us immediately of any unauthorized use of your account
2.3 Acceptable Use
You agree NOT to:
Use the Service for any illegal purpose
Upload malicious code, viruses, or harmful content
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service
Violate any applicable laws or regulations
Impersonate any person or entity
Collect user data without consent
3. Lifetime Deal Terms
3.1 Payment
360Onboard offers lifetime access through one-time payments
All prices are in USD
Payments are processed securely through our payment provider
3.2 License Grant
Upon payment, we grant you a non-exclusive, non-transferable, perpetual license to use the Service according to your purchased tier (Starter, Professional, or Agency).
3.3 Refunds
You have 30 days from purchase to request a full refund
After 30 days, all sales are final
Refunds are processed within 5-10 business days
3.4 Downgrades
You may downgrade to a lower tier within 30 days of purchase
Downgrades can be processed directly in your account portal
Refund amount will be the difference between tiers
3.5 Upgrades
You may upgrade to a higher tier at any time
Upgrade cost is the difference between your current tier and new tier at current pricing
If purchased during a discount period and upgrading after, you pay current non-discounted rates
4. Service Features and Limitations
4.1 Tier Limitations
Your access to features is based on your purchased tier:
Starter: 5 active flows, 5 clients/month, 5 e-signatures/month
Professional: 10 active flows, 15 clients/month, unlimited e-signatures
Agency: Unlimited flows, clients, and e-signatures
4.2 Fair Use Policy
While certain tiers offer "unlimited" usage, we reserve the right to limit abuse or excessive usage that negatively impacts Service performance for other users.
4.3 Coming Soon Features
Features marked as "coming soon" are planned but not guaranteed. We will make reasonable efforts to deliver these features within stated timelines.
5. Data and Content
5.1 Your Data
You retain ownership of all data you upload to the Service
You grant us a license to store, process, and display your data to provide the Service
You are responsible for backing up your data
5.2 File Storage
Files uploaded to the Service are automatically deleted after 60 days for security purposes
You are responsible for maintaining copies of important files
5.3 Client Data
You are responsible for obtaining necessary consents from clients whose data you collect
You must comply with applicable data protection laws (GDPR, CCPA, etc.)
6. Intellectual Property
6.1 Our IP
The Service, including all code, design, logos, and content, is owned by DDS Media Marketing LLC and protected by intellectual property laws.
6.2 Your IP
You retain all rights to your content, branding, and materials uploaded to the Service.
7. Service Availability
7.1 Uptime
We strive to maintain high availability but do not guarantee uninterrupted access. We are not liable for any downtime or service interruptions.
7.2 Maintenance
We may perform scheduled or emergency maintenance that temporarily affects Service availability.
7.3 Service Changes
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
8. Third-Party Services
The Service may integrate with third-party services (payment processors, email providers, etc.). Your use of these services is subject to their respective terms and policies.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE
10. Indemnification
You agree to indemnify and hold harmless DDS Media Marketing LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
11. Termination
11.1 By You
You may stop using the Service at any time. Lifetime licenses remain valid unless terminated by us for cause.
11.2 By Us
We may terminate your account if you:
Violate these Terms
Engage in fraudulent activity
Abuse the Service or other users
Fail to pay applicable fees (for upgrades or additional services)
11.3 Effect of Termination
Upon termination, your access to the Service will cease. You may export your data before termination.
12. Modifications to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of new Terms. Material changes will be notified via email.
13. Governing Law
These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict of law principles.
14. Dispute Resolution
Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
